IRS TAX LEVY

What is a Levy?

A levy is a legal seizure of your property by the IRS to pay the government for a tax debt. Levies are different from liens. A lien is a claim used as security for the tax debt, while a levy actually takes the property to satisfy the tax debt.

If you do not pay the  taxes claimed due by the IRS  (or make and Installment Arrangements or Offer In Compromise to settle your debt), the IRS will seize and sell any type of real estate or personal property that you own. Even if you owne the property jointly with a spouse or partner, the IRS will try to take the property. For example, the IRS can:

-seize and sell property that you hold (such as your car, boat, or house),

or

- levy property that is yours but is held by someone else (such as your wages, retirement accounts, dividends, bank accounts, licenses, rental income, accounts receivables, the cash loan value of your life insurance, or commissions )

or

-take your Social Security

Fighting the IRS to stop and release a levy takes prompt action by a Tax Lawyer. Once technique is compelling the IRS to hold a  Collection Due Process hearing with the Office of Appeals  I will file a written  request for a Collection Due Process hearing with the IRS.  Remember, we must file your request within 30 days of the date on your notice or you do not get a hearing.

Do not delay! Waiting could make you lose your rights and give the IRS an even bigger advantage. Immediately call ROnald J. Cappuccio, J.D. LL.M.(Tax) at (856) 665-2121.
